2. Terms of Service

2.1 Payment Terms & Authorization

All purchases require full and valid payment prior to shipment. By placing an order, the buyer represents and warrants that:

• They are the authorized account holder or have authorization to use the selected payment method
• Sufficient funds or credit are available at the time of purchase

Payments that are returned, reversed, declined, or marked NSF (Non-Sufficient Funds) must be resolved prior to the scheduled shipment date.

• Orders with unresolved NSF or failed payments prior to shipment day will not be shipped.
• The Seller reserves the right to cancel any order if payment is not successfully resolved within a reasonable timeframe.

2.2 Refusal of Service

The Seller reserves the right to refuse service, cancel orders, or restrict purchasing privileges for buyers who:

• Initiate chargebacks
• Fail to resolve NSF or failed payments
• Abuse dispute processes
• Violate this policy

2.3 Policy Acceptance & Modifications

By completing a purchase, the buyer affirms that they have read, understood, and agreed to this policy in its entirety.

The Seller reserves the right to update or modify this policy at any time. The version in effect at the time of purchase governs the transaction.

2.4 Governing Law, Venue & Jurisdiction (Tennessee)

This policy and all transactions arising from it shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict-of-law principles.

The buyer agrees that exclusive venue and jurisdiction for any legal action arising from or related to this policy or any transaction shall lie in the state or federal courts located within the State of Tennessee, and expressly consents to personal jurisdiction therein.

Age of Consent & Parental Responsibility
By using this site, you represent that you are at least the age of majority in your jurisdiction, or that you are the age of majority and have authorized any minor dependents to use this site. Financial responsibility for purchases rests solely with the account holder or parent/guardian.

User Conduct
We reserve the right to refuse service, terminate accounts, or cancel subscriptions at our sole discretion for abusive conduct, fraud, or violation of these terms.

Governing Law
These Terms of Service are governed by the laws of the State of Tennessee.

2.6 Policy Construction, Supremacy & Anti-Ambiguity Clause

This policy shall be interpreted as a single, integrated agreement governing all transactions between the Buyer and Hickory Dust N Dimes, LLC dba Hickory Dust N Dimes. In the event of any perceived inconsistency, ambiguity, or conflict between sections of this policy, the provisions shall be interpreted in a manner that gives maximum effect to the Seller’s intent, including but not limited to the All Sales Final policy, limitation of remedies, and allocation of risk.

Headings, section titles, summaries, examples, or explanatory language are provided for convenience only and shall not limit, expand, or otherwise modify the operative terms of this policy.

Any reference to refunds, returns, replacements, or remedies shall be construed narrowly, shall apply only where expressly authorized herein, required by applicable law, or mandated by a payment processor or court of competent jurisdiction, and shall not be deemed to create any general right or expectation of refund or return.

No ambiguity in this policy shall be construed against the Seller. The Buyer expressly waives any rule of construction that would interpret contractual ambiguities against the drafting party.

This clause shall survive termination, cancellation, chargebacks, disputes, and fulfillment of any transaction and shall apply to all disputes, collections, and enforcement actions arising from or related to this policy.
